A concept too difficult for most to understand.
Kit Maira of Easyriders magazine informed me that a friend of his, Richard Quigley, got a Santa Cruz County judge to declare the California helmet law unconstitutional while acting as his own attorney. "The state Department of Justice has asked the 6th District Court of Appeal to block Superior Court Judge Michael Barton's order..."
"Quigley's case stems from nine helmet law citations from July 2003 to August 2004 -- four were written by Watsonville police and five by the CHP. In all but one of the cases, Quigley wore some type of headgear -- usually a baseball-type cap -- that had some certification saying it complied with federal regulations."
A heroic move. If he's got the time and wherewithal to deal with the courts, god bless him. It seems that the statute does not clearly define what a helmet is. Here's the court ruling.
We commonly head over the Ohio border (70 miles away) so we can take the lids off and do what the hell we want concerning our heads. Funny, we often go over the (other) border to Canada, and those birds check specifically for a DOT helmet, and without it, you can't pass Go. They are very aware of the novelty helmets with the fake DOT decals, so those don't go over.
